Vanaya.ai – Terms & Conditions

Effective Date: 28 November 2025

1. Introduction

Welcome to Vanaya.ai (“the Platform”). These Terms & Conditions (“Terms”) govern your access and use of our services, applications, and subscription-based features. By registering or using Vanaya.ai, you agree to be bound by these Terms. If you do not agree, you must discontinue use of the Platform. These Terms must be read together with our Privacy Policy, Refund Policy, and Subscription Agreement.


2. Definitions

  • “User”: Any individual who accesses or uses Vanaya.ai.
  • “Subscriber”: A paying user under the official subscription plan.
  • “Services”: All platform features described in Section 5.
  • “Coming Soon Features”: Features announced but not yet deployed (Face Analytics, Speech-to-Text Analytics).
  • “Platform”: All systems, applications, APIs, and digital products under Vanaya.ai.

3. Eligibility

You must be at least 18 years old or have legal capacity to enter binding agreements under Indonesian law.


4. Account Registration

To use Vanaya.ai, you must:

  • Provide accurate registration information
  • Maintain the confidentiality of your login credentials
  • Accept responsibility for all activities under your account

We reserve the right to suspend accounts involved in misuse, fraud, or breach of these Terms.


5. Service Scope & Feature Status

As of the effective date, the Platform provides:

5.1 Active Services (Available Now)

  • Coaching Log
  • Audio Recording
  • Whiteboarding / Picture Upload
  • AI Informed Chat Bot (accessible only for active subscribers)

5.2 Coming Soon (Not Yet Operational)

  • Face Analytics (Morphcast integration postponed)
  • Speech-to-Text Analytics (internal development stage)

Users acknowledge that:

  • “Coming Soon” features are not active,
  • No data of any kind is processed for those features,
  • No charges are imposed for upcoming features.

This aligns with the Privacy Policy and Subscription Agreement.


6. Subscription & Payment Terms

  • Vanaya.ai currently offers one subscription tier: Rp 50.000/user/month.
  • Subscriptions are billed in advance monthly.
  • The full Subscription Agreement (updated 28112025) applies.
  • Payments are non-refundable except under the circumstances outlined in the Refund Policy.
  • Failure to pay may result in suspension or termination of access.

7. Acceptable Use Policy

Users must not:

  • Access or attempt to access features or servers without authorization
  • Interfere with the operation of the Platform
  • Use the Platform to upload harmful content or malicious code
  • Reverse-engineer, copy, or redistribute any part of the Platform
  • Use the Platform for unlawful purposes under Indonesian law

We reserve the right to suspend or terminate accounts for violations.


8. Privacy & Data Protection

Your use of Vanaya.ai is governed by our Privacy Policy (updated 28112025).

Key points:

  • We comply with UU PDP No. 27/2022, GDPR, and APEC Privacy Framework.
  • We collect only minimal personal data necessary for service delivery.
  • As of the current date:
    • No biometric, facial, or voice data is collected.
    • No data is shared with Kata.ai or Morphcast, as integrations are not active.
  • Data for Coming Soon features will not be collected until explicit consent is obtained.

9. Communication

By using the Platform, you consent to receiving:

  • Account notices
  • Security alerts
  • Service updates
  • Feature announcements
  • Billing notifications

Communication is delivered via email or in-platform messaging.


10. Intellectual Property

All content, software, branding, and materials on Vanaya.ai are the exclusive property of Vanaya International and protected under applicable IP laws. Users are granted a limited, non-exclusive, non-transferable license to use the Platform for personal or organizational purposes.


11. Service Availability

We strive to maintain 99% uptime but do not guarantee uninterrupted access due to:

  • Maintenance
  • Technical issues
  • Force majeure events
  • Internet disruptions

No compensation is provided for temporary downtimes unless stipulated in the Refund Policy.


12. Termination

You may terminate your subscription at any time via your dashboard. Access remains active until your paid period ends.

Vanaya.ai may terminate access if:

  • You violate the Terms
  • Fraud or misuse is detected
  • Required by law or regulation

All termination policies follow the Subscription Agreement.


13. Limitation of Liability

To the maximum extent permitted by law:

  • Vanaya.ai is not liable for indirect, incidental, or consequential damages.
  • Maximum liability for any claim is limited to the last monthly subscription fee paid.
  • We are not responsible for user-side issues such as:
    • Poor network connection
    • Device/browser incompatibility
    • Local hardware or software failure

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of Indonesia. Any dispute shall be resolved through the competent courts in Jakarta.


15. Updates to These Terms

Vanaya.ai may revise these Terms to reflect:

  • Legal requirements
  • Feature changes
  • Operational updates

Significant changes will be communicated through email or in-platform announcements.
